1. Preamble
A contract is exclusively concluded between the user of the Internet service www.whereisthelove.tk (hereinafter User) and Marcin Gburski, Kolejowa 10/4, 62-600 Kolo, Poland. (hereinafter Operator).
2. Services
2.1. The Operator provides on www.whereisthelove.tk a fee-based space dedicated User's picture in the form of a Grid(s)/Poster(s) in size 1000x1000pixels each. For blocks of at least 20x20 pixels the User can acquire the right to place his photo and a link which lead to a website of the User.
The User does not become owner of any part of the website www.whereisthelove.tk.
2.2. Each one block of 20x20 pixels, 400 pixels (four hundred pixels), costs as much as specified on the homepage(s) and on pages during the reservation process called 'Upload a Photo'.
2.3. The user can buy any number of remaining free adjacent 20x20px blocks. The placement of the logo can be selected, if the required number of adjacent blocks is still available.
2.4. To purchase the pixels the User initially reserves a desired number of directly adjacent blocks. As part of the reservation process the User is asked to specify a link and an email address, and also to upload his picture.
2.5. The contract will only be concluded when the Operator releases the reservation and the User has paid the reserved block(s). An order have to be paid at the latest within two days, otherwise the reservation is cancelled. The User always has the option to reserve blocks again.
2.6. Any request for displaying picture on www.whereisthelove.tk will be carefully proved by the Operator and not released and published unless both the photos and links provided by the User as well as the websites referred to by the photos and links do not present obscene, offensive, adult, discriminatory or any other content breaching the rights of any third parties. The Operator reserves the right to reject pictures and links without giving a reason and without any reimbursement of User's costs.
2.7. If the contents of the linked websites are changed by the User after the activation of blocks in a way that these contents are in breach of legal provisions or seem from the perspective of the Operator for other reasons no longer acceptable, these blocks are immediately blocked. The User is then requested by the Operator to insert acceptable content over which the operator decides again regarding a release. If the User does not fulfil this request he loses in such a case any further claims on use of participation of the www.whereisthelove.tk. He will not get back his amount paid.
2.8. Paid and released blocks will remain at least 4 (four) year unchanged with regard to contents and will stay at the same place.
2.9. Submitted pictures shall conform to the format purchased in pixels. If they differ as far the size is regarded the photos must be stretched or compressed which can cause distortion.
2.10. With the submission of picture, link and link's title you acknowledge that you have the right to publish photo and link to our site.
2.11. You shall be the owner of the picture(s) you want to place on the Grid.
2.12. In cases of copyright infringement the Operater reserves the right to remove image and link from the website without any comment.
3. Right of withdrawal for consumer
3.1. If the User is a consumer, he may withdraw his contractual declaration within 3 days without giving reasons in writing (Email or letter). The withdrawal must be sent to:

3.2. Consequences of Withdrawal
In case of an effective withdrawal, the mutually received benefits are to be returned and any benefits (e.g. interest) surrendered. The return of the performance by the Operator is done by blocking the blocks on Grid.
Obligations to reimburse payments must be fulfilled from the Operator within 30 days.
This time period begins with the Operator receiving the withdrawal.
3.3. Special Notes
The User's right of cancellation expires prematurely if the contract is completely fulfilled by both parties at the express request of the User before the User has exercised his right of withdrawal.
4. Obligations of the User
The User is obligated to use the access to www.whereisthelove.tk in compliance with law and to respect the law and the rights of third parties. The User shall ensure that the data entered by him at www.whereisthelove.tk will not violate legal regulations, in particular the protection of young people, the personal rights of third parties and the violation of property rights, particularly copyrights. The user fails to supply data with immoral and criminally relevant content.
5. Liability
The liability of the Operator to the User in connection with the use of the service, in particular for the availability, errors and limitations and / or the loss of the functionality of the service, including liability for financial loss and consequential damages, including damages for loss of profits and loss of data or other information is excluded. Basically, the Operator is not responsible for technical failures.
The Provider explicitly dissociates itself from all the contents of all the websites linked to www.whereisthelove.tk. The data, comments, views, opinions, representations, services, offers, or other information contained on these websites or made available through the website or made accessible do not constitute a recommendation to buy or participate.
A liability for property damages, which may possibly result from the attraction of information for the User's own decision, is excluded. No liability is assumed by the Operator for the accuracy, completeness or timeliness of any information contained on the Affiliate Site.
The links set by the User on www.whereisthelove.tk lead to external websites, over which the Operator has no influence. Therefore, the Operator takes no responsibility for their content. The respective provider or operator of the pages is always responsible for the content of linked websites. The linked websites were checked at the time of linking for possible violations of law. Illegal contents were not recognisable. A permanent control of the linked pages is unreasonable without concrete evidence of a violation. Upon notification of violations, the Operator will remove such links immediately.
6. Personal Information Protection
The personal data of the User is strictly confidential and will not be disclosed to third parties. The user agrees, however, that data of him which are collected by www.whereisthelove.tk exclusively for the purposes of this Contract may be stored and processed for internal, statistical and anonymous evaluation purposes.
With regard to the personal data of the User the Operator calls to attention that data these are stored in accordance with applicable data protection regulations.
7. Cookies
7.1. Cookies are small text files that are stored on User computer or equipment when User visit certain online pages that record his preferences.
Operator uses cookies to track use of the website www.whereisthelove.tk. Operator may also use cookies to monitor traffic, improve the website and make it easier and/or more relevant for User.
7.2. Our use of cookies:
a) On Registration:
These cookies will hold information collected during User registration and will allow Operator to recognise User and provide him with the services he requires.
b) Website:
For Users to Operator's website, We use cookies to collect information. Operator's servers use two different types of cookies:
- A 'session-based' cookie: This type of cookie is only allocated to User computer for the duration of his visit to the service www.whereisthelove.tk. A session-based cookie helps User move around the website faster and allows Operator to give User information that is more relevant to him. This cookie automatically expires when User close his browser.
- A 'persistent' cookie: This type of cookie will remain on User's computer for a period of time set for each cookie.
7.3. Cookies enable Operator to:
- Identify User's preferences when customising content or functionality for him.
- Avoid too often need to enter a password and Email address.
- Confirm User is a registered user and save his login details when accessing the website www.whereisthelove.tk.
- Opertor use cookies to measure the effectiveness of the website www.whereisthelove.tk, services, content and advertising.
- Operator may also use cookies and web beacons to ensure that Our mailing tools are working properly.
7.4. Refusing cookies:
User has the ability to accept or decline cookies. Most web browsers automatically accept cookies, but, if User prefer, he can usually modify his browser setting to decline cookies. The Help menu on the menu bar of most browsers will tell User how to prevent his browser from accepting new cookies, how to have the browser notify him when he receive a new cookie and how to disable cookies altogether.
If User choose to decline cookies, he may not be able to experience all of the interactive features available via the Operator's website.
8. Copyrights
Certain data on www.whereisthelove.tk are the intellectual property of the Operator. All other data are the property of the relevant information-, data-, product- or service-provider or third parties that provide such data to www.whereisthelove.tk. The data is protected by copyright and other rights.
All property rights shall remain as appropriate with the relevant supplier or third parties that provide such data to specific service providers.
9. Applicable Law / Place of Jurisdiction
9.1. All legal relations between the operator and the Users are subject to the Polish law.
10. Severability
If any provision of this agreement is determined to be or become invalid, such determination will not impair or affect the validity of the remaining provisions. In such a case the invalid provision shall rather be construed in such a way that the parties' original intent, as far as legally permissible, can be reached. The same applies to a contractual gap.
